Attorney General Chris Carr praised an 11th Circuit U.S. Court of Appeals ruling in favor of the City of Pensacola. At question was a World War II monument in the shape of a cross in a Pensacola park. The ruling will help similar monuments including one in Fort Oglethorpe along the trail in the Chickamauga Battlefield.
AG Carr said:
We strongly believe that memorials like this one do not violate the Constitution and should be protected and preserved. Today’s ruling is a great win and provides clear guidance as we continue working to protect these kinds of memorials in Georgia.
The 11th Circuit’s decision reads in part:
Even if the original purpose of [the] monument was infused with religion, the passage of time may obscure that sentiment, and … a community may preserve such monuments, symbols, and practices for the sake of their historical significance or their place in cultural heritage.
