A Strong Georgian to Consider for Scalia’s Replacement
As Barack Obama considers who should replace Supreme Court Justice Antonin Scalia (and he should be able to, this is pure crybaby-ism from Republicans and Democrats would do the same thing were they in the GOP’s shoes, too), there’s a Georgian who should be strongly considered: former Supreme Court of Georgia Chief Justice Leah Ward Sears.
She has impeccable legal credentials, would bring more diversity to the SCOTUS, was appointed by a then-Democrat and, most notably, she would bring some sorely-needed intellectual diversity to the SCOTUS not coming from the Federal Appeals Courts and one of the same two Ivy League law schools.
What’s problematic is that she’s been retired for seven years, SCOGA and SCOTUS aren’t really comparable in their work and she does have a long list of decisions that could sink her nomination. Oh, and if The New York Times is to be believed, she’s not on the shortlist.
I’ve emailed Sears’ law office for comment and will update if I hear back.

David Nahmias would be a fine candidate for SCOTUS.
Has Nahmias ever served on a US court? Attorney, yes, but a court?
No fed judiciary experience but others have served w/o such experience.
I hereby formally announce that, at this point in time, I will not accept an appointment to the Supreme Court should one be forthcoming. However, it would be prudent of me to keep an open mind regarding the subject.
Sears seems an unlikely nominee, but I wonder how Georgia’s Senators would react if her name were put forward.
Based on her views on death penalty and other issues it would be highly unlikely either of our two current senators would support a Sears nomination.
We already have one Georgian on the court. I doubt there will be two any time soon, if ever, regardless of party or ideology.
She would have been a good pick when Obama had his first pick, and I also thought she would be a good pick. If Obama comes up with a middle of the road pick, its going to put Mitch in a jam…not to mention the 6-8 seats in play in the Senate this year.
More importantly, is she Jewish or Catholic? Jews and Catholics only please.
